Términos y condiciones de la garantía limitada de ORBITVU

Términos generales

Los presentes Términos y condiciones de la garantía limitada ("Términos y condiciones") cubren los servicios prestados por ORBITVU a los clientes ("Clientes") que hayan adquirido productos de hardware y/o software ("Productos") de ORBITVU sp. z o.o. ("ORBITVU") o de los revendedores autorizados de ORBITVU.

Salvo que se especifique lo contrario en otro acuerdo escrito y firmado por personal autorizado de ORBITVU, estos Términos y condiciones constituyen el acuerdo completo y exclusivo con respecto a los términos y condiciones de la garantía y del servicio de los productos de la marca ORBITVU. Estos Términos y condiciones reemplazan cualquier acuerdo o declaración anterior, incluidas las declaraciones hechas en el material escrito de ventas de ORBITVU o los consejos brindados al Cliente por ORBITVU, por un revendedor autorizado o por un empleado de ORBITVU, que pudieran haberse realizado con relación a la compra del Producto por parte del Cliente.

Estos Términos y Condiciones se regirán por las leyes de la República de Polonia.

ORBITVU podrá, a su entera discreción, modificar los Términos y condiciones en cualquier momento y cuando resulte oportuno. En caso de que alguna disposición de estos Términos y condiciones sea considerada nula por cualquier ley o norma de cualquier gobierno o tribunal, dicha nulidad no afectará la aplicabilidad de las demás disposiciones de estos Términos y condiciones.

Garantía limitada para el hardware

ORBITVU garantiza que cada producto está libre de defectos en los materiales y la mano de obra.

ORBITVU garantiza que reparará o cambiará, a discreción propia de ORBITVU, sin cargo alguno para el Cliente, todo Producto que no funcione correctamente en condiciones de uso normal durante el Período de garantía limitada ("Garantía limitada").

El "Período de garantía limitada" comienza en la fecha de envío del Producto al Cliente directamente desde ORBITVU o desde un distribuidor autorizado.

El Período de garantía limitada para el hardware para todos los productos de hardware es de 12 meses bajo condiciones de uso normal.

La Garantía se puede extender opcionalmente (comprando la opción de extensión de garantía), siempre que el período de garantía total no sea superior a tres (3) años, la garantía sea continua y la opción de extensión se compre antes de que haya vencido el Período de garantía anterior.

Condiciones de uso normal significa el uso durante cinco (5) días hábiles a la semana y ocho (8) horas de trabajo por día.

Se puede solicitar al Cliente que presente un comprobante de compra como condición para recibir el servicio de garantía. Esta Garantía limitada se extiende solo al comprador original (usuario final) y no es transferible.

La Garantía limitada NO entrará en vigencia hasta que ORBITVU o su distribuidor autorizado reciba el monto total adeudado de la factura de compra.

Cualquier Producto que ORBITVU haya autorizado para ser reemplazado o reparado deberá ser devuelto a ORBITVU o indicado por el servicio de reparación de ORBITVU, a cargo del Cliente. Una vez que ORBITVU o el servicio de reparación recibe el Producto, el Producto reparado o reemplazado será enviado nuevamente al Cliente, a expensas de ORBITVU.
ORBITVU está obligado a reparar o reemplazar y enviar el Producto devuelto dentro de los 10 días hábiles a partir de la fecha de recepción del Producto.

ORBITVU se reserva el derecho, a su entera discreción, de reembolsar el precio de compra en lugar de reemplazar el Producto.

Piezas de repuesto para el cliente (PRC)

La Pieza reemplazable por el cliente (PRC) se aplica a la falla del producto donde el defecto identificado está relacionado con una pieza cuyo mantenimiento y servicio puede ser, según lo determine ORBITVU, realizado por parte del cliente. Las PRC pueden incluir unidades de motor, fuentes de alimentación y/o reemplazos completos del chasis. ORBITVU proporcionará instrucciones detalladas sobre el reemplazo de las PRC en forma de instrucciones impresas y/o videos tutoriales en línea y/o manuales e instrucciones en línea.

Servicios in situ

ORBITVU puede, a su entera discreción, determinar si un defecto se puede reparar de una de las siguientes maneras:

  • Remotamente

  • Mediante el uso de una PRC, donde el cliente realiza una reparación de autoservicio

  • Mediante una visita de servicio técnico en el lugar donde se encuentra la unidad defectuosa

Si ORBITVU finalmente determina que se requiere una visita de servicio técnico para reparar la falla, el Cliente proporcionará al personal que presta los Servicios, a cuenta del Cliente y en la fecha programada: (i) acceso completo y libre a los Productos y el uso de cualquier producto, accesorio, documentación, software, sistema de diagnóstico u otro equipo necesario para brindar el Servicio; y (ii) espacios e instalaciones de trabajo y almacenamiento adecuados y seguros según sea razonablemente necesario para el personal que preste los Servicios, incluidos, entre otros, calefacción, iluminación, ventilación y corriente eléctrica y enchufes adecuados. El Cliente será el único responsable de mover los muebles, el equipo, los materiales almacenados o cualquier otroobjeto que se requiera mientras el personal de Servicios esté en las instalaciones del Cliente.

Exclusiones

ORBITVU no tendrá la obligación de proporcionar ninguna garantía o Servicios, ni podrá, a discreción exclusiva de ORBITVU, cobrar tarifas adicionales por: (a) Productos alterados o modificados o Productos de los cuales se ha eliminado el número de serie o cualquier sello de garantía, o que se han dañado o estén defectuosos; (b) Productos que se dañen como resultado de reparaciones por parte de cualquier persona que no sea ORBITVU o su Proveedor de servicios, accidentes, uso indebido o excesivo, u otras causas externas o que no estén relacionadas con ningún error del Producto; (c) Productos usados de manera distinta a la especificada en el manual de usuario o las especificaciones de ORBITVU o que se utilicen fuera de los parámetros de uso establecidos en la documentación del usuario.

Las piezas desgastadas, que se desgastan durante el uso normal, como, entre otras, las ruedas de fricción, los protectores acrílicos, fondos, tubos de luz fluorescente, etc. están excluidas de la garantía si su función se degrada debido al desgaste normal.

Garantía limitada para el software y soporte de mantenimiento

ORBITVU garantiza que la funcionalidad del software para los Productos especificados se ajustará sustancialmente a las especificaciones publicadas, para el hardware específico (marca y modelo de PC y cámara) y versión del sistema operativo, por un período de 12 meses a partir de la fecha de compra.

Esta garantía limitada se extiende solo al cliente final como licenciatario original.

ORBITVU identificará, según su propio criterio, los siguientes problemas de software:

  • Errores críticos: problemas del software que impiden el uso del hardware o software

  • Errores no críticos: problemas del software que no impiden la utilización del software y hardware

  • Solicitudes de funciones: solicitudes de mejoras del software

Durante este período de Garantía limitada para el software, ORBITVU proporcionará a sus clientes los siguientes servicios de soporte y mantenimiento de software:

  • Soporte de software por teléfono durante el horario comercial: 8 a.m. - 4 p.m. CET

  • Soporte de software por correo electrónico: ORBITVU responderá cualquier solicitud de soporte por correo electrónico dentro de los 2 días hábiles

  • Soporte técnico en la Web: soporte en línea 24/7/235 en un sitio web específico

  • Actualizaciones de software gratuitas y actualizaciones desde un sitio web específico

  • Correcciones de errores críticos

  • Correcciones de errores no críticos

  • Actualizaciones de funciones

El cliente deberá informar los problemas del software y proporcionará toda la información necesaria para que ORBITVU identifique el problema. Información mínima requerida:

  • Descripción del problema: comportamiento esperado y comportamiento erróneo, pasos necesarios para reproducir el problema

  • Versión del software

  • Tipo y versión del sistema operativo

  • Versión de marca, modelo y firmware de la cámara digital (en caso de que el problema esté relacionado con la cámara)

  • Versión de firmware y modelo del producto de hardware de ORBITVU (en caso de que el problema esté relacionado con el hardware)

ORBITVU proporcionará el siguiente soporte de software para problemas específicos de software:

  • Errores críticos: ORBITVU, según su propio criterio, proporcionará una nueva versión de software (actualización) dentro de los 10 días hábiles a partir del informe de problemas, o proporcionará información sobre la nueva configuración del hardware, lo que solucionará el problema.

  • Errores no críticos: ORBITVU solucionará el problema en la siguiente actualización importante de software

  • Solicitudes de funciones: ORBITVU decidirá, según su propio criterio, si proporcionará o no la versión de software actualizada que incluya la nueva función, y cuándo la proporcionará.

Previa solicitud, el Cliente proporcionará a ORBITVU acceso remoto a una computadora con el software instalado para una mayor investigación.

Exclusiones

El software desarrollado específicamente o modificado de acuerdo con los requisitos específicos del cliente no está cubierto por los términos y condiciones de la garantía y está sujeto a un acuerdo específico con el cliente.

ORBITVU se reserva el derecho de proporcionar soporte solo para las últimas versiones de software: números de versiones principales actuales y anteriores.

El software de terceros está incluido en el Software. El software de terceros es cualquier componente de software o software de código abierto, gratuito o de terceros, proporcionado por ORBITVU pero con licencia independiente. Es posible que ORBITVU no pueda proporcionar soporte de mantenimiento ni garantía para el software de terceros.

Datos y privacidad

ES RESPONSABILIDAD EXCLUSIVA DEL CLIENTE GENERAR UNA COPIA DE SEGURIDAD DE SUS DATOS Y ASEGURARSE DE QUE TODOS SUS DATOS SEAN DUPLICADOS ADECUADAMENTE. ANTES DE PERMITIR LA REVISIÓN DE CUALQUIER PRODUCTO, EL CLIENTE DEBERÁ RESPALDAR SUS DATOS Y ELIMINAR TODA INFORMACIÓN CONFIDENCIAL, PRIVADA O PERSONAL. NI ORBITVU NI SUS PROVEEDORES DESERVICIOS SERÁN RESPONSABLES POR NINGUNA INFORMACIÓN PRIVILEGIADA O CONFIDENCIAL CONTENIDA EN CUALQUIER PRODUCTO, HARDWARE, SOFTWARE O MEDIO. NI ORBITVU NI SUS PROVEEDORES DE SERVICIOS TENDRÁN NINGUNA RESPONSABILIDAD DERIVADA DE CUALQUIER DAÑO O PÉRDIDA DE DICHOS DATOS MIENTRAS EL PRODUCTO SE ENCUENTRE EN POSESIÓN DE ORBITVU O DEL PROVEEDOR DE SERVICIOS.

Descargo de responsabilidad

CON EXCEPCIÓN DE LO ESTABLECIDO EXPRESAMENTE EN ESTOS TÉRMINOS Y CONDICIONES, ORBITVU NO OTORGA NINGUNA OTRA GARANTÍA, EXPRESA O IMPLÍCITA, INCLUYENDO CUALQUIER GARANTÍA IMPLÍCITA DE COMERCIABILIDAD E IDONEIDAD PARA UN PROPÓSITO EN PARTICULAR. ORBITVU NO GARANTIZA QUE LAS FUNCIONES DE LOS PRODUCTOS CUMPLIRÁN CON LOS REQUISITOS DE LOS CLIENTES O QUE NO SERÁN INTERRUMPIDAS O QUE ESTARÁN LIBRES DE ERRORES. ORBITVU LIMITA SU PROPIA RESPONSABILIDAD Y LA DE SU PROVEEDOR DE SERVICIOS EN LA MEDIDA PERMITIDA POR LA LEY APLICABLE.

Limitaciones de responsabilidad

BAJO NINGUNA CIRCUNSTANCIA ORBITVU, SU PROVEEDOR DE SERVICIOS O CUALQUIER AFILIADO, EMPLEADO, FUNCIONARIO, DIRECTOR O REPRESENTANTE SERÁN RESPONSABLES POR NINGÚN DAÑO CONSECUENTE, INDIRECTO, ESPECIAL, PUNITIVO O INCIDENTAL, YA SEA PREVISIBLE O FORTUITO, INCLUIDOS, ENTRE OTROS, LOS RECLAMOS POR PÉRDIDA DE DATOS, FONDO DE COMERCIO, INCONVENIENTES, RETRASOS, GANANCIAS, USO DE DINERO, ETC.

LA RESPONSABILIDAD TOTAL DE ORBITVU Y DEL PROVEEDOR DE SERVICIOS Y LA ÚNICA Y EXCLUSIVA SOLUCIÓN PARA LOS RECLAMOS DEL CLIENTE RELACIONADOS O RESULTANTES DE ESTOS TÉRMINOS Y CONDICIONES POR CUALQUIER CAUSA, INDEPENDIENTEMENTE DE LA FORMA DE LA ACCIÓN, YA SEA CONTRACTUAL O EXTRACONTRACTUAL, ESTATUTARIA O DE OTRO TIPO, INCLUSO POR NEGLIGENCIA Y RESPONSABILIDAD OBJETIVA, NO EXCEDERÁ EL MONTO DE LAS TARIFAS DEL SERVICIO QUE EL CLIENTE HAYA PAGADO A ORBITVU DURANTE EL PERÍODO ESPECÍFICO EN EL CUAL OCURRIÓ DICHO DAÑO. ESTA LIMITACIÓN DE RESPONSABILIDAD SERÁ APLICABLE AUN CUANDO EL CLIENTE HAYA INFORMADO A ORBITVU O A SU PROVEEDOR DE SERVICIOS SOBRE LA POSIBILIDAD DE DICHOS DAÑOS.

ORBITVU Limited Warranty Terms & Conditions

General Terms

These Limited Warranty Terms and Conditions (“Terms and conditions”) cover services provided by ORBITVU to customers (“Customers”) who have purchased hardware and/or software products (“Products”) from ORBITVU sp. z o. o. (“ORBITVU”) or from ORBITVU’s authorized resellers.

Unless otherwise specified in another written agreement, signed by authorized ORBITVU personnel, these Terms and Conditions constitute the complete and exclusive agreement regarding the warranty and service terms and conditions of ORBITVU branded Products. These Terms and Conditions supersede any prior agreements or representations—including representations made in ORBITVU sales literature or advice given to Customer by ORBITVU, an ORBITVU authorized reseller, or employee thereof—that may have been made in connection with Customer’s purchase of the Product.

These Terms and Conditions will be governed by the laws of the Republic of Poland.

ORBITVU may in its sole discretion modify the Terms and Conditions at any time and from time to time. If any provision of these Terms and Conditions is held invalid by any law or regulation of any government or by any court, such invalidity will not affect the enforceability of other provisions in these Terms and Conditions.

Limited Hardware Warranty

ORBITVU warrants that each Product is free from defects in materials and workmanship.

ORBITVU warrants, that at ORBITVU’s own discretion, it will provide new Customer Replacement Parts to be replaced by customer (see CRP definition below), or repair the Product by itself, or exchange the Product for a new one, without any charge to Customer, each Product failing to function properly, under normal use during the Limited Warranty Period (the “Limited Warranty”).

Normal use means 5 working days a week and 8 working hours per day.

The “Limited Warranty Period” starts on the date of Product shipment to the customer directly from ORBITVU or from authorised reseller.

Limited Hardware Warranty Period for all hardware products is 12 month under normal use.

The Warranty can be optionally extended (by purchasing warranty extension option), provided that the total warranty period is not bigger than 3 years, the warranty is continuous and that the extension option is purchased prior the previous Warranty Period has expired.

Customer may be required to provide proof of purchase as a condition of receiving warranty service. This Limited Warranty is extended to the original end-user purchaser only and is not transferable.

Limited Warranty is NOT in effect until ORBITVU, or its authorised reseller receives full due amount of purchase invoice.

Any Product, which ORBITVU has authorized to be replaced or repaired must be returned to ORBITVU or indicated by ORBITVU repair service, at Customer’s expense. Once ORBITVU or repair service receives the Product it will be repaired - and shipped back to the Customer, at ORBITVU’s expense. ORBITVU is obliged to repair or to replace the Product - within 10 working days from the date of it`s reception.

ORBITVU reserves the right, at its sole discretion, to refund the purchase price instead of replacing the Product.

Customer Replacement Part (CRP)

The Customer Replaceable Part (the CRP) applies to product failure where the identified defect is related to a part that can be, as determined by ORBITVU, self-serviced by Customer. The CRP may include motor drives, power supplies, and/or whole chassis replacements. ORBITVU will provide detailed instructions on replacement of the CRP in a form of printed instructions and/or online tutorial videos and/or online manuals and instructions. The customer is obliged to send - the broken part at it’s own expense to ORBITVU. ORBITVU will ship the CRP to the customer within 5 working days from the date the broken part was received at its own expense. In special situations, ORBITVU at its own discretion may accept to send CRP before it received the broken part from the customer.

On-Site Services

ORBITVU may, at its sole discretion, determine if a defect can be repaired in one of the following ways:

  • Remotely

  • By the use of CRPs, and customer performing a self-service repair

  • By a service call at the location of the defective unit

If ORBITVU ultimately determines that an on-site service call is required to repair the defect, Customer will provide to the personnel providing the Services, at Customer's expense and at the scheduled: (i) full and free access to the Products and the use of any product, attachment, documentation, software, diagnostics or other equipment necessary to provide Service; and (ii) adequate and safe working and storage space and facilities as reasonably needed by personnel providing Services, including, without limitation, adequate heat, light, ventilation and electrical current and outlets. Customer will be solely responsible to move furniture, equipment, stored materials or any other objects as required while Services personnel are at Customer's premises.

Exclusions

ORBITVU will have no obligation to provide any warranty or Services for, or may in ORBITVU’s sole discretion charge additional fees for: (a) altered or modified Products or Products from which the serial number or any warranty seal has been removed or that have been damaged or rendered defective; (b) Products that are damaged as a result of repairs by anyone other than ORBITVU or its Service Provider, accident, misuse, abuse, or other external causes or not related to any Product error; (c) Products used other than as specified in the ORBITVU user’s manual or specifications or operated outside the usage parameters stated in the user documentation;

Wearing parts, which are subject of wearing out during normal use, such as, but not limited to: friction wheels, acrylic pads, backgrounds, fluorescent light tubes, etc. are excluded from the warranty, if their function degrades due to normal wear out.

Limited Software Warranty and Maintenance Support

ORBITVU warrants that the software functionality for specified Products will substantially conform to its published specifications, for specified hardware (PC, camera make and model) and operating system version, for a period of time of 12 month from the date of purchase.

This limited warranty extends only to the end customer as the original licensee.

ORBITVU, will identify, under it’s own discretion, following software issues:

  • critical bugs - software issues which do not allow to use hardware or software

  • non critical bugs - software issues which do not preclude software and hardware from being used

  • feature requests - requests for software improvements

During this Limited Software Warranty period, ORBITVU will provide to it’s customers software support and maintenance services:

  • phone software support during it’s business hours: 8ap - 4pm CET

  • e-mail software support - ORBITVU will respond to any e-mail support requests within 2 working days sent to e-mail: support@orbitvu.com

  • web technical support - 24/7/235 online support on a dedicated web site

  • free software updates and upgrades from dedicated web site

  • critical bug fixes

  • non critical bug fixes

  • feature updates

Customer will report software issues, providing all necessary information, needed to identify the issue by ORBITVU. Minimal information required:

  • Issue description: expected behaviour and erroneous behaviour, steps necessary to reproduce the issue

  • Software version

  • Operating System type and version

  • Digital camera make, model and firmware version (in case the issue may be camera related)

  • ORBITVU Hardware product model and firmware version (in case the issue may be ORBITVU Hardware related)

ORBITVU will provide following software support for specific software issues:

  • critical bugs - ORBITVU, at it’s own discretion, will provide a new software version (update) within 10 working days from the issue report, or will provide information about new hardware/software configuration, which will fix the issue.

  • non critical bugs - ORBITVU will fix the issue within next major software upgrade

  • feature requests - ORBITVU will decide, upon it’s own discretion, whether and when to provide updated software version, which will include the new feature

Upon request, Customer will provide to ORBITVU remote access to a computer with installed software for further investigation.

Exclusions

Software specifically developed or modified according to specific customer requirements, is not covered by this warranty terms and conditions and is subject to a specific agreement with a customer.

Orbitvu reserves the right to provide the support only for the latest versions of the software: current and previous major version numbers.

Third Party Software is included in the Software. Third Party Software is any third party, free or open source software or software component provided by ORBITVU but separately licensed. ORBITVU may not be able to provide maintenance support nor warranty for third party software.

Data and Privacy

IT IS CUSTOMER’S SOLE RESPONSIBILITY TO MAKE BACK-UP COPIES OF IT’S DATA AND TO ENSURE THAT ALL OF ITS DATA ARE ADEQUATELY DUPLICATED. BEFORE ALLOWING SERVICE OF ANY PRODUCT, CUSTOMER MUST BACK-UP DATA AND REMOVE ANY OF CUSTOMER’S CONFIDENTIAL, PROPRIETARY, OR PERSONAL INFORMATION. NEITHER ORBITVU NOR ITS SERVICE PROVIDERS WILL BE LIABLE FOR ANY CONFIDENTIAL OR PRIVATE INFORMATION OR DATA CONTAINED IN ANY PRODUCT, HARDWARE, SOFTWARE OR MEDIA. NEITHER ORBITVU NOR ITS SERVICE PROVIDERS WILL HAVE ANY LIABILITY ARISING OUT OF ANY DAMAGE TO OR LOSS OF SUCH DATA WHILE THE PRODUCT IS IN ORBITVU OR THE SERVICE PROVIDER POSSESSION.

Disclaimers

EXCEPT AS EXPRESSLY SET FORTH IN THESE TERMS AND CONDITIONS, ORBITVU MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ORBITVU DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE PRODUCTS WILL MEET THE CUSTOMERS’ REQUIREMENTS OR BE UNINTERRUPTED OR ERROR-FREE. ORBITVU LIMITS ITS OWN AND ITS SERVICE PROVIDER’S LIABILITY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

Limitations of Liability

UNDER NO CIRCUMSTANCES WILL ORBITVU, ITS SERVICE PROVIDER OR EITHER’S AFFILIATES, EMPLOYEES, OFFICERS, DIRECTORS OR AGENTS BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL, PUNITIVE, OR INCIDENTAL DAMAGES, WHETHER FORESEEABLE OR UNFORESEEABLE, INCLUDING, BUT NOT LIMITED TO, CLAIMS FOR LOSS OF DATA, GOODWILL, INCONVENIENCE, DELAY, PROFITS, USE OF MONEY.

ORBITVU'S AND THE SERVICE PROVIDER'S ENTIRE LIABILITY AND CUSTOMER'S SOLE AND EXCLUSIVE REMEDY FOR CLAIMS RELATED TO OR ARISING OUT OF THESE TERMS AND CONDITIONS FOR ANY CAUSE AND DESPITE THE FORM OF ACTION, WHETHER IN CONTRACT OR IN TORT, STATUTORY OR OTHERWISE, INCLUDING NEGLIGENCE AND STRICT LIABILITY, WILL NOT EXCEED THE AMOUNT OF THE SERVICE FEES THAT CUSTOMER PAID TO ORBITVU DURING THE PARTICULAR TERM IN WHICH SUCH DAMAGE OCCURRED. THIS LIMITATION OF LIABILITY WILL BE EFFECTIVE EVEN IF CUSTOMER HAS ADVISED ORBITVU OR ITS SERVICE PROVIDER OF THE POSSIBILITY OF ANY SUCH DAMAGES.
